Welcome to FaceRead (the "Service"), operated by Cimbolic Productions LLC ("we," "us," or "our").

By accessing, browsing, or using https://faceread.live (the "Site") or any related services, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

FaceRead is an AI-powered facial analysis platform that provides personality insights and character analysis based on your uploaded photograph.

The Service includes:

• AI-driven facial feature analysis using Grok-4 (xAI)
• Narrative personality report generation using GPT-4o (OpenAI)
• PDF report download functionality
• Secure payment processing through Stripe

You acknowledge that: AI-generated insights are speculative, probabilistic, and subject to error. You should not rely on FaceRead results for any important life decisions. Always consult qualified professionals (doctors, psychologists, lawyers, etc.) for serious matters.

You must meet the following requirements to use FaceRead:

• Age Requirement: You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher).
• Parental Consent: If you are under 18, you must have permission from a parent or legal guardian to use the Service.
• Legal Capacity: You must have the legal capacity to enter into binding contracts.
• Jurisdiction Compliance: You must not be prohibited from using the Service under applicable laws.

You may create an account using Google, GitHub, Discord, or email authentication. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

FaceRead offers a one-time Deep Analysis for $0.99 USD.

• Payment is processed securely through Stripe (PCI DSS Level 1 certified)
• We do not store your credit card information
• Prices may change at any time without notice
• Price changes do not affect completed purchases

We may, at our discretion, offer promotional credits or free analyses. These are non-transferable and subject to expiration.

By uploading your photograph, you explicitly consent to our collection, use, and storage of your biometric information (facial geometry data).

You agree to:

• Upload only your own photograph or photos for which you have explicit permission
• Provide a clear, front-facing photo that accurately represents yourself
• Use the Service only for personal, non-commercial purposes
• Comply with all applicable laws and regulations
• Keep your analysis results private and not share them publicly in a way that violates others' rights

You may NOT:

• Upload photos of other people without their explicit consent
• Upload photos of minors without parental permission
• Use the Service for employment screening, credit decisions, or any legally regulated purpose
• Attempt to reverse engineer, decompile, or extract our AI models or algorithms
• Scrape, harvest, or automatically collect data from the Site
• Use the Service to harass, stalk, or harm others
• Submit false, misleading, or fraudulent information
• Circumvent payment systems or attempt unauthorized access
• Violate any applicable laws, including biometric data laws (BIPA, GDPR, CCPA)

9.1 Our Rights

All content, code, design, trademarks, logos, and intellectual property on FaceRead are owned by Cimbolic Productions LLC or our licensors. This includes:

• The FaceRead name, logo, and branding
• Website design, layout, and user interface
• Proprietary AI analysis algorithms and prompts
• All text, graphics, and multimedia content

9.2 Your Rights

You retain ownership of your uploaded photograph. However, by using the Service, you grant us a limited, worldwide, non-exclusive license to process, analyze, and store your photo for the purpose of generating your analysis.

Your Analysis Report: You own the analysis report generated for you and may download, save, or share it as you wish (subject to our entertainment disclaimer).

FaceRead integrates with third-party services to operate:

• Stripe – Payment processing
• OpenAI (GPT-4o) – Narrative generation
• xAI (Grok-4) – Facial analysis
• Supabase – Database and storage hosting
• Railway – Application hosting (US West)

Your use of these services is subject to their respective Terms of Service and Privacy Policies. We are not responsible for third-party practices, outages, or data breaches.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or completeness of AI-generated results
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties that defects will be corrected or that the Site is free of viruses

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Emotional distress, reputational harm, or personal injury
• Damages arising from reliance on AI-generated analysis results
• Unauthorized access, data breaches, or third-party actions

MAXIMUM LIABILITY: In any event, our total liability to you for all claims arising from the Service shall not exceed the amount you paid us in the past 12 months (i.e., $0.99).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Cimbolic Productions LLC, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights (including privacy, publicity, or intellectual property rights)
• Your uploading of photos without proper consent
• Any content you submit to the Service

14.1 Arbitration Agreement

• Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules

Upon termination, your right to use the Service will immediately cease. You may still request deletion of your biometric data as described in our Privacy Policy.

We reserve the right to modify or update these Terms at any time. When we make material changes, we will:

• Notify you via email (if you have an account) or through a prominent notice on the Site

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service.
